
Musical Bingo Functions
Terms & Conditions
1. Application
These terms and conditions apply to all private musical bingo functions bookings and constitute a binding agreement between BQ and you. By engaging our services, you accept the terms of this Agreement in full.
2. Booking Fee
(a) Subject to clause 2(c), the booking fee stated in the Schedule above shall be the only fees payable by you to BQ in respect of this event.
(b) A 30% deposit on the booking fee is payable by you upfront, in order to secure the booking. Subject to clause 9, the deposit is non-refundable. The balance of the booking fee shall be payable in accordance with the terms stated on our invoice. We are under no obligation to provide the services unless you pay the booking fee in full prior to the event.
(c) Further booking fees may be payable in the following circumstances:
(i) Where the number of guests in attendance at the event exceeds the number of guests for which an invoice has been rendered, BQ will issue a further invoice to You for the a higher attendance bracket as quoted; and/or
(ii) Where the event is extended as a result of the late arrival of guests, inclusion of live auctions, delays to start time or break time, requests to stay late, or any other causes for delay or longer attendance outside our Host’s control, further booking fees will be charged at $160 per hour per Host, calculated from the event finish time specified in the Schedule to the time our Host departs the event.
Any invoice issued under clause 2(c) must be paid within 7 days.
3. Conduct of the event
BQ will attend at your selected venue to conduct the event in the manner booked.
4. Audio
The audio required for this event includes speakers and microphones. Where the number of guests at the event is less than 150 people, BQ will provide all audio. Where the number of guests at the event is more than 150 people, you (or your selected venue) must provide all audio.
5. Intellectual Property
All intellectual property rights in or in relation to the operation of the event, format of the event, the materials (in whatever form) associated with the event, the prizes, custom event menus and all other such rights in connection with the event are owned by BQ. You must not copy or reproduce any aspect of the event at the venue or at any other venue, or authorise or instruct any third party to do the same.
6. Licenses and authorisations
You warrant and represent to BQ that you have obtained all rights at law to conduct the event, including all necessary licenses, permits, authorisations and approvals, and that the event will be held lawfully in compliance with all relevant legislation in force at the time of the event. You indemnify BQ in relation to any and all loss, damage or expense (on a full solicitor-client basis) suffered by BQ as a result of a breach of these warranties and representations.
7. Bingo permit information
The Gaming and Wagering Commission Act 1987 and its Regulations applies to Musical Bingo events. Our format of Musical Bingo involves elements of skill (guests must identify the song in order to mark it off) and chance (each bingo cards has a unique combination of songs, and cards are distributed at random).
Fundraising events
In some circumstances, minor fundraising activities (events raising money for the benefit of community, cultural, ethnic or charitable purposes which are not for private gain or any commercial undertaking) may be held without requiring a permit. If you intend to hold your event within this exemption, you undertake to BQ that:
All funds raised via your event will go towards your fundraising purposes;
The total value of prizes on offer will not exceed $200; and
The bingo element of the event will not form the only (or the only substantial) inducement to attend the event. We help you fulfil this requirement by the nature of the event we put on. Each Musical Bingo event you book with us is a full entertainment package comprising other competitive and fun elements for your guests in addition to bingo (including song identification, additional games and competitions, and dance-related activities). On your part, the inclusion of raffles, auctions, social interaction and community support may also offer substantial inducements for guests to attend.
Non-fundraising events
Where your event will not be wholly for fundraising purposes, or you other cannot satisfy the criteria above, you will need to obtain a permit through the WA Department of Local Government, Sport and Cultural Industries. The fee is around $24 per event (as February 2024).

8. Cancellation / Postponement
(a) You may cancel an event at any time.
(b) BQ may cancel an event where you breach the terms of this Agreement in any way, and in that case we shall not be obliged to repay any booking fees paid by you.
(c) Subject to clause 9, if you cancel or postpone the event less than 2 weeks from the original booking date, your booking fee shall become immediately due and payable in full.
(d) You may postpone your event to a date on which BQ is available, and in such case we will carry over your booking deposit (or booking fee, if fully paid at the time of the postponement) to the new date. Events postponed less than 2 weeks from the original booking date may incur a $200 postponement fee. Postponed events which may later be cancelled will not be refunded.
(e) You acknowledge and agree that the charges set out in this clause are reasonable and fair, having regard to the preparatory work to be undertaken by us in the lead up to the event, and the allocation of staff and resources to the exclusion of other bookings.
9. COVID-19
(a) BQ endeavours to respond to all government mandates relating to COVID-19 efficiently and quickly. All Hosts are required to satisfy vaccination mandates in order to attend work. Our staff are directed to refrain from attending work if experiencing symptoms consistent with COVID-19 or if required to isolate or quarantine.
(b) You are solely responsible for ensuring your event, guests and event personnel comply with all COVID-19 conditions at the event, including but not limited to:
(i) implementing relevant hygiene and safety measures;
(ii) social distancing;
(iii) mask wearing;
(iv) proof of vaccination; and
(v) directing all personnel and guests to refrain from attending the event if experiencing symptoms consistent with COVID-19, or if they are required to isolate or quarantine.
(c) If at any time:
(i) government mandated COVID-19 restrictions are introduced; and
(ii) these restrictions are in force as at the date of your event; and
(iii) due to these restrictions it would be unlawful to hold your event in the manner set out in the Schedule for your booking,
the following applies:
(iv) You may elect whether you want to cancel or postpone the event;
(v) if You elect to cancel the event, BQ will refund any booking fees paid;
(vi) if You elect to postpone the event, BQ will work with you to re-list your event to a mutually suitable date;
(vii) in the absence of your election within 30 days, BQ will cancel Your booking and retain any booking fees paid.
In all other cases, BQ is under no obligation to refund any portion of the booking fees.
10. Loss and damage
To the maximum extent permissible by law:
(a) We do not accept responsibility for any loss or damage to the venue caused by patrons of the venue; injury, illness or other damage to patrons sustained at the venue; loss of clothing or personal items; or any other loss or damage suffered by patrons of the venue. You accept full responsibility for each of the above items, and agree to indemnify BQ on a full solicitor-client basis in relation to any claims made, threatened or brought by any third parties against us in relation to such loss or damage.
(b) You indemnify BQ against any loss or damage caused by any person at the venue other than our host/s, in relation to PA or other equipment supplied by us for the purposes of the event. To the extent any damaged PA or other equipment is capable of repair, You must pay to BQ immediately upon demand the full cost of repair charged by repairers engaged in our sole discretion. To the extent any damaged PA or other equipment is incapable of repair, you must pay to BQ immediately upon demand the full replacement cost in relation to the damaged PA or other equipment.
(c) You are solely responsible for ensuring the event complies with any and all laws, regulations and governmental mandates/directives in force at the time of the event. You indemnify BQ on a full solicitor-client basis against any claims made, threatened or brought by any third parties against us in relation to a breach of this clause, including any penalties or fines imposed as a result of non-compliance with clause 9.
11. Dispute Resolution
Where a dispute arises out of or in connection with this Agreement, a duly authorised representative of each party must within 10 days of the dispute arising, meet in good faith to try and resolve the dispute before instituting legal proceedings. Nothing in this clause prevents the parties from commencing proceedings for urgent interlocutory relief where appropriate.
12. Safety & Harrassment
BQ is committed to ensuring the safety of our Hosts. We rely on you to ensure that when our Hosts are on your premises or at your event, you will take all reasonable and necessary steps to ensure the personal safety of our Hosts, and to prevent any instance of harassment or endangerment of welfare. Where a Host notifies any organiser or person responsible for your event of a Safety Incident, you must immediately take all appropriate action to address the Safety Incident. This includes:
identifying the person/s who have caused or are contributing to the Safety Incident;
monitoring the conduct of the person/s following the Host’s notification of the Safety Incident by assigning a staff member or other responsible representative to the immediate area surrounding the Host for the remainder of the event;
reprimanding or reproaching any conduct that the Host considers is inappropriate conduct;
if the Safety Incident relates to harassment, abuse or serious danger to a Host, immediately ejecting the responsible person/s from the event venue and calling the police;
escorting the Host to his or her car following the conclusion of the event;
making a written record of the Safety Incident and reporting the incident to BQ within 24 hours of the event; and
taking all other steps as may be necessary to ensure the safety and wellbeing of the Host.
13. Amendments to Terms
We reserve the right to amend these terms from time to time.
14. General
This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all other agreements or representations pertaining to the same. No variation to this Agreement shall be valid unless in writing signed by each of the parties. No waiver shall be effective unless in writing. This Agreement is subject to the exclusive jurisdiction of the laws in force in Western Australia from time to time.
Defined Terms
“Agreement” means these terms and conditions.
“BQ / us / we” means PBSK Management Pty Ltd trading as Bamboozled Quizmasters.
”Host” means a BQ host or other staff member.
“Safety Incident“ means an incident or action, which has either occurred or which a Host anticipates may occur, concerning the personal safety or wellbeing of a Host.
“Schedule” means the schedule set out in the booking confirmation, which contains the specific details relevant to your event.
“you / your” means, in respect of any booking, the client noted in the Schedule.
